Filing for a Washington City Divorce Decree

Divorce cases in Washington City follow Utah state law. The case is filed at the Fifth Judicial District Court in St. George. Every step of the process creates a record that becomes part of the official Washington City Divorce Decree file.

The first step is the residency requirement. Under Utah Code § 30-3-1, at least one spouse must have lived in Utah and in Washington County for at least three months before filing. Washington City residents who meet this requirement can file at the Fifth District Court. If you moved to Washington City recently, check that you have reached the three-month mark before submitting your petition.

Utah divorce law allows both no-fault and fault-based grounds. Irreconcilable differences is the no-fault option and the most common path. Fault grounds under Utah Code § 30-3-1 include adultery, willful desertion for more than one year, habitual drunkenness, felony conviction, willful neglect to provide necessities of life, and cruel treatment causing bodily injury or great mental distress. Washington City residents may choose whichever ground applies to their situation.

You file the petition at the Fifth District Court clerk. The filing fee is approximately $330. After filing, you must serve the respondent spouse with the divorce papers. Utah allows service by a licensed process server, the Washington County Sheriff, or other court-approved methods. You must file proof of service before the case can advance to the hearing stage.

A mandatory waiting period applies before the court can enter a final Washington City Divorce Decree. Under Utah Code § 30-3-18, this period is at least 30 days from the date of filing. When minor children are part of the case, the waiting period extends to 90 days. Utah also requires both parents to complete a divorce orientation education course under Utah Code § 30-3-11.2 when children are involved.

Once all conditions are met and any contested issues are resolved, the judge signs the final order. The Washington City Divorce Decree is then entered into the public court record under Utah Code § 30-3-4. Property and debts are divided under Utah Code § 30-3-5 based on what the court determines is equitable given the circumstances of the case.

Phone: (801) 538-6105.

Note: Utah classifies divorce records as public under Utah Code § 63G-2-201, but certain private information within the file may be protected under Utah Code § 63G-2-302, such as Social Security numbers and financial account details.
